Whenever we are standing in front of ICE, CPB or DHS or any participating law enforcement, particularly those wearing masks, and hiding their identity be sure to capture as many photos and video as possible. Especially prior to their violent assaults on individuals. We should capture photos of their hands, forearms, tattoos, ears, profile if masked, their particular ways of standing or walking, the ways their shoe soles wear, etc. Next you should capture videos of their cruel and aggressive violence.
These photos and videos can then be used to prosecute the law enforcement who take violent action against persons of color, protestors and innocent bystanders under color of authority.
Section 149 of the California Penal Code describes violations of California law by and government agent “under color of authority”. This refers to an officer using the power or influence of his/her position to abuse a person without any lawful necessity, we see this every time ICE grabs an innocent victim of fascist executive orders against law abiding Immigrants and POC and even sometimes US Citizens. In California, it is a crime for law enforcement to use force or violence against anyone without justification or consent.
Two sections of the California Civil code also protect California Residents. That is Sec. 52.1 (aka Bane Act) which prohibits officers from interfering with a person’s Constitutional Rights through threats, intimidation, or violence. The Bane Act was recently amended to deny officers qualified immunity for these violations.
The second: California Civil Code Section 51.7 (The Ralph Civil Rights Act) works together with the Bane Act prohibiting police violence, unlawful force or threats by law enforcement to use violence based on an individuals protected characteristics such as color, religion or national characteristics.
Taken together, we have all witnessed hundreds of violations by federal law enforcement in our county alone.
At the Federal Level: 42 U.S.C. allows us to bring CIVIL RIGHTS lawsuits against government agents who violate our Constitutional Rights under the Color of law.
We are ALL Californians and should enforce our civil rights against ICE.
